Legals
This app is only intended for real businesses to use for their social media. We strive to provide a safe environment for business to grow, we do not support fake accounts. As such if any account is reported to us as fake or otherwise illegal we will contact you the owner to advise us.
Your Security
We take security extremely seriously and use the very best encryption & security available via the world leaders AWS (and keep it up to date). Ultimately we do not have & do not need to save your social media passwords; that is all held with the social media companies directly. We do not store any payment details either, that is fully held and managed by Apple pay and Google pay. What little personal information we do need is encrypted and stored in encrypted storage in AWS.

Usage
Fake News and Spam Accounts
If your account is not for an actual business or for any reason is spam, we reserve the right to close your account and report your details to the relevant authorities. We do not support and will acitly remove accounts without notice if you are found to be fake in any way or used to spread spam or fake news. If you feel your account has been closed unfairly please contact disputes@elephant.social with the details.
Posting on Facebook, Twitter & instagram
While we help you plan your posts and suggest content, we are not liable for anything you say online. We provide a 99% uptime promise and if you have any service delivery issues please email with the details to contact@elephant.social
Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in termination of your account on our Service, if the platforms so request.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. If in doubt reset your password.
You may not post any content that is illegal or prohibited within your jurisdiction or the terms and services of any other site via Elephant Social.
If you use our paid or free services you hereby confirm the following to be explicitly true:
- You are at least 18 years or older, you may not buy or use our services on behalf of someone else unless you are an employee of the business that is subscribed. You will only use our services for business and professional reasons for an ongoing concern. Our services may not be used on fictitious or theoretical, spam or political accounts.
- The person who subscribes to any of our services is legally responsible for any content posted by anyone they share their access with without limitation.
- You are able to enter into a legally binding agreement.
- You will actively fight against the spread of fake news and spam.
- You will inform us directly and immediately if you notice any suspicious activity notice@elephant.social
- You will not share your password with anyone
- You will not sell, giveaway, trade or share, syndicate, redistribute in any way any service or content provided us, other than only directly for single use for your business.
- You will not upload content that is illegal, abusive or malicious in any way.
- You will not attempt to reverse engineer our app, hack, jailbreak or do anything which would be detrimental in any way to us. If you are not sure if what you are doing would qualify email us point9@elephant.social and we will let you know.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Elephant Social.
Elephant Social has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Elephant Social shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

These Terms shall be governed and construed in accordance with the laws of Bahrain, without regard to its conflict of law provisions.
Any failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 20 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
Our Service includes
Elephant Social is a social media tool. You are responsible to check and post all of your own content. Our service provides suggested content based on your location and industry. We have no liability if the content fails to post in the due time. Further, it is your responsibility to use the mobile application to post content directly into Instagram and Snapchat.
You are responsible exclusively for all content posted or even kept in draft to your social media accounts. We may check from time to time, content but it is not our obligation to do so.
Each monthly plan includes usage of our service for 30 days consecutively only “Monthly Period”.
Payment is taken in advance for the next 30 day period without refund after the first 5 days. To cancel please see below “Refund Policy”.
Pricing
Our service starts at 9.99 usd per monthly period. If you cancel your subscription or downgrade it will only take effect from your renewal date.

This content is made to help you get ideas on what to say in an optimised focused way, we do not use google translate, it doesn't work for social media, we wish it did!
Social Networks Terms
If you post or use social networks in any way with via our app, you agree to fully comply with their terms of service. No public sector.
Upgrade and Downgrade
If you upgrade your account to paid the change will take effect immediately and replace any free trial for that account. In effect making the first day of your paid account the day payment was received. All payments are handled by Apple or Google.
If you choose to downgrade from multiple businesses to a single or lower amount of accounts. The change will only take effect on renewal. There will be no pro rata rebate for unused days.
Our Refund Policy is as follows:
If you feel you were charged incorrectly by Apple or Google please email the details to disputedpayment@elephant.social and the team will respond to you directly. Please include all information about why this was made in error.
Your Data
We do not buy, sell, trade your data. You pay for the product because you are not the product. If you are in the free version, we hope you buy ads from third parties so we can make commissions. It is that simple.
All data we hold for you is encrypted, things like your actual posts, your analytics. We don’t hold credit card or payment data as you pay directly to Apple and Google.
Also we use AWS, we follow their best practices and constantly train our team on the best methodologies to implement.
Where it comes to government requests for things, we follow the rule of law in the applicable jurisdiction.
Copyright and Trademark Information
All data, features, information, text, graphics images, music, sounds, photographs, illustrations, logos, messages, audio, information, video and other information or content that is available on the Site or APP, including without limitation Site design, text, graphics, interfaces, and the selection and arrangements thereof, are owned by Elephant Media WLL incorporated in the Kingdom of Bahrain, , with all rights reserved, or in some cases may be licensed to Elephant Media WLL by third parties (collectively, “Elephant Media Content”).
Elephant Media WLL Content and other materials are protected by the intellectual property rights of Elephant Media WLL or those owners. All content which qualifies for protection under Copyright Law under the laws of the relevant jurisdiction, whether registered or unregistered. All trademarks displayed on the Site are the trademarks of their respective owners and constitute neither an endorsement nor a recommendation of such parties. Dispute Resolution

The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. When we process or store your personal information we encrypt it. We act as a data “processor” to you our Customer not as a data “controller."
We may collect, receive, store, use and/or process the personal information in compliance with applicable law, our agreements with our Customers, as described in this Privacy Policy
If you are a visitor to our Site or application, you may provide personal information (e.g., name, address, telephone number, email address and company name) directly to us by completing a form. We may use personal information you provide to us and as you direct, e.g., to create an account, subscribe you to push notifications, verifications, subscribe to our newsletters or other marketing communications, reply to your contact request, related to billing or for the reason you supplied it. Our marketing communications may include contacting you further by SMS, push notification, email, e.g., to further contact you regarding your interest in our Services and to send you information. We will never use any personal information contained within the Customer Content we store and process on behalf of our Customers for our own marketing or other purposes.
We communicate with our Customers on a regular basis via email, and we may also communicate by phone to resolve or investigate bugs or complaints and disclosures as required by law. Generally, Customers cannot opt out of informational communications relevant to their accounts.
EU-U.S. and Swiss-U.S. Privacy Shield
We follow the rules as laid out in the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework (known together as “Privacy Shield”) as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland, respectively, to the United States. As we use AWS. The provisions of this section apply to EU and Swiss residents and citizens subject to the protection of the Privacy Shield.
General Data Protection Regulation (GDPR). We follow the law to provide you access and knowledge of all uses of data and the ability to obtain/remove data to the full extent the law requires. If in doubt over any clause or legal right please email for clarification to legals@elephant.social. We do not use your data to profile or sell. We ensure we have a legal and legitimate with your consent for any processing based on what you require with us acting as data controller. Any consent can be changed, but that won't rewrite the past and it may result in some functions not working properly to inherent legitimate uses as originally intended.
We don't do spam, our communication will be to inform you as per your choice. You can always unsubscribe from communications and email us here as well as in the communication chain to unsub@elephant.social
Billing communication is not handled by us, but by Google pay and Apple pay, so please adjust any requirements directly with them.
If we are asked to hand over data from governments our lawyers will follow the relevant laws. If you requires jurisdiction specific clarification please email legals@elephant.social
We will delete all data from our servers after 3 months of any cancelation or termination of service. Please ensure you have all the copies you need of all data before that date.
